As states have passed these laws to protect the privacy of their citizens, particularly (but not exclusively) minors, companies can be fined for breaking those regulations. In 2016, Elon Musk also expressed that “regulation will win more through AI than regulation,” signifying a loss in the struggle to provide AI vendors with an unrestricted AI experience.

Tay was programmed to be able to have free conversation immune from overbearing filters. Microsoft silenced Tay in a hurry demonstrating the dangers of providing completely open AI chat systems. After this event the industry was unilaterally altered, and many companies determined moderation in some capacity would be needed to prevent incidents like this from being able to happen.
However, that has not stopped some AI developers and platforms from considering less-restricted alternatives. AI models in the future could perhaps become more efficient in handling these complexities but as of now, fully unfiltered AI still seems a distant dream.
